Terms of Service

These Terms of Service govern access to and use of the WiseFollow platform, a software-as-a-service (SaaS) solution operated by WiseSolutions SpA, a company incorporated in Chile.

WiseFollow is a B2B SaaS platform for HSE management, operated by WiseSolutions SpA (Chile). You can cancel your subscription at any time. Payments for active periods are generally non-refundable except in cases described in our Refund Policy. We do not develop, train, or sell our own generative AI models; any AI-assisted features operate through external providers via APIs. 2.Description of the service

WiseFollow is a B2B SaaS platform for companies, occupational health and safety professionals, prevention specialists, consultants, and organizations that need to manage processes related to workplace safety, operational compliance, and document management.

The platform may include, among others, modules for inspections, risk assessments, contractor compliance, training, incident reporting, document management, preventive work programs, action plans, and related processes.

The service is provided through web access and is offered under subscription plans.

3.Registration and user account

To use WiseFollow, the customer or user must create an account and provide truthful, complete, and up-to-date information.

The user is responsible for maintaining the confidentiality of their login credentials and for all activities performed through their account.

WiseSolutions SpA may suspend or restrict access if it detects misuse, false information, breach of these terms, or risks to the security of the platform.

4.Plans, payments, and billing

WiseFollow is offered through subscription plans, which may be monthly, annual, or any other format available at the time of purchase.

Online payments may be processed by external payment providers, including Paddle, which may act as Merchant of Record or payment processor, as applicable.

The customer agrees to pay the amounts disclosed at the time of purchase, including applicable taxes, renewal charges, and any other amount disclosed before confirming the purchase.

The current prices, plan features, and commercial conditions will be those published on the website, within the platform, or communicated at the time of purchase. WiseSolutions SpA may modify plans, prices, or features going forward. Such changes will not affect subscription periods already paid, unless expressly stated or required by applicable law.

5.Renewal and cancellation

Subscriptions may renew automatically according to the selected plan.

The customer may cancel their subscription through the means enabled in the platform, through the payment provider, or by requesting cancellation via WiseFollow contact email.

Cancellation prevents future renewals but does not necessarily entitle the customer to a refund for periods already paid, except as stated in the Refund Policy or where applicable law provides otherwise.

6.Permitted use

The user agrees to use WiseFollow only for lawful, professional purposes related to business, operational, document, preventive, or compliance management.

7.Customer content and data

The customer retains ownership of the information, documents, records, evidence, forms, reports, and other data uploaded to the platform.

WiseSolutions SpA may process such data only to provide the service, maintain platform operations, deliver support, improve functionality, comply with legal obligations, and protect system security.

The customer is responsible for the legality, accuracy, and relevance of the data entered into WiseFollow.

8.Artificial intelligence and external providers

WiseFollow does not develop, train, or sell its own generative artificial intelligence models.

Where AI-assisted features exist, they may operate through external providers via their APIs, with the purpose of supporting productivity, automation, analysis, or assisted information generation within the platform.

The user must review and validate any AI-assisted output before using it for legal, employment, technical, preventive, or compliance decisions.

9.Availability and support

WiseSolutions SpA will use reasonable efforts to keep the platform continuously available. However, the service may be interrupted due to maintenance, updates, technical failures, force majeure, connectivity issues, or third-party services.

Support will be provided through the channels communicated by WiseFollow, according to the selected plan.

10.Intellectual property

WiseFollow, including its software, design, structure, features, trademarks, content, documentation, and visual elements, belongs to WiseSolutions SpA or its licensors.

Use of the platform does not transfer to the customer any intellectual property rights over WiseFollow.

11.Limitation of liability

WiseFollow is a management support tool. The customer is responsible for reviewing, validating, and applying the information generated or managed in the platform according to their operational context, internal rules, and applicable law.

To the maximum extent permitted by law, WiseSolutions SpA will not be liable for indirect losses, loss of profits, loss of data, business interruption, or damages arising from the use or inability to use the platform.

12.Third-party services

WiseFollow may integrate with or depend on third-party services, such as infrastructure, payment, email, analytics, storage, artificial intelligence, or other technology providers.

WiseSolutions SpA does not control those external services and will not be responsible for interruptions, changes, or failures attributable to third parties.

13.Suspension or termination

WiseSolutions SpA may suspend or terminate access by a user or customer in the event of breach of these terms, misuse, non-payment, security risk, or legal requirement.

The customer may stop using the platform and cancel their subscription in accordance with the conditions applicable to their plan.

14.Changes to these Terms

WiseSolutions SpA may update these Terms of Service when necessary to reflect legal, commercial, technical, or operational changes.

The current version will be available on the WiseFollow website.

15.Governing law

These Terms of Service will be governed by the laws of the Republic of Chile, unless mandatory consumer protection rules or other applicable laws provide otherwise.
